Terms and Conditions of Use

These Terms of Use (the "Terms") govern the mobile game Block Up! (the "Game").

We, GAMEBUSTER LTD, a limited liability company incorporated in the Republic of Cyprus, with its registered office at Potamos Germasogeias, 38B Ampelakion, Germasogeia 4046, Cyprus (the "Company", "we", "us"), publishes the Game and the services around it (the "Services") on the conditions set out below.

Downloading, installing, or playing the Game means you (the "Player") accept these Terms together with any operating rules and policies we publish for the Game. We may revise any part of them whenever we consider it necessary, and a revised version takes effect the moment it appears at this address; keeping an eye on this page is left to you. A Player who does not accept these Terms should not install the Game and should remove it from their device.

By using the Services you confirm one of two things: either you have reached the age at which a binding contract may be concluded where you live, or a parent or legal guardian has approved your use of the Game. In both cases the age limits applied by the store you downloaded the Game from continue to apply to you.

1. Scope of the Terms

Except where stated otherwise, these Terms cover the Game and every related build, service, and technology run by the Company or its Affiliates. "Affiliate" here means a person or entity holding a controlling interest in the Company, held by it, or sitting under the same ownership control, including their subsidiaries.

2. General Terms

Playing the Game binds you to these Terms exactly as a signed agreement would. Where a Player breaks them, we may act without warning and without owing compensation — changing, limiting, or closing any part of the Game, for instance by:

• limiting the hours or regions in which the Game or a particular feature runs;
• capping how much a Player may use a given feature;
• suspending or ending one Player's access altogether.

Such a suspension may take effect immediately. Neither you nor any third party may claim damages from us because of it.

From time to time we publish extra conditions covering one specific feature, event, or piece of content ("Additional Terms"). They carry that label and are read alongside these Terms.

3. Licence to Use the Game

Subject to your full compliance with these Terms, we grant you a revocable, non-transferable, non-exclusive, limited licence to install and use one copy of the Game on a device that you own or control, for your personal, non-commercial entertainment use only.

Everything inside the Game — code, graphics, artwork, level layouts, animation, sound, music, and text (together, the "Content") — either belongs to us or is licensed to us, and is covered by copyright, database rights, trademarks, trade secrets, and comparable protections. That protection holds in every medium and format, present or future, under Cypriot and European Union law and its equivalents elsewhere.

You may not, and may not permit any third party to:

• copy, reproduce, distribute, publicly display, or create derivative works from the Content, except as expressly permitted by these Terms or by mandatory law;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game, except to the extent such restriction is prohibited by applicable law;
• modify, patch, or create unauthorised copies, clones, cheats, bots, mods, or automation tools for the Game;
• circumvent, disable, or interfere with security, advertising, or purchase-related features of the Game;
• sell, rent, lease, sublicense, or otherwise commercially exploit the Game or any part of it;
• remove, obscure, or alter any copyright, trademark, or other proprietary notice.

All trademarks appearing in the Game are the trademarks of their respective owners.

4. Eligibility and Age

The Game is intended for users aged 13 and over (or 16 and over in jurisdictions where that is the applicable minimum age for consent to data processing). The Game is not directed to children under those ages. See section 11 and our Privacy Policy.

The Game does not require you to create an account with the Company. Where the Game offers an optional sign-in through a platform service such as Google Play Games, your use of that service is additionally governed by the terms and privacy policy of the relevant platform provider.

5. In-App Purchases and Virtual Items

The Game may offer optional in-app purchases, such as removal of advertisements, in-game currency, boosters, or other virtual items ("Virtual Items"). All purchases are processed exclusively by the app distribution platform from which you obtained the Game (Google Play or the Apple App Store). We do not receive, process, or store your payment card details.

Virtual Items are licensed, not sold, to you. They have no monetary value, cannot be exchanged for cash or any item of value outside the Game, and may not be transferred, sold, or traded. We may modify, replace, or discontinue any Virtual Item at any time. Your licence to use Virtual Items ends when your licence to use the Game ends, whether through termination, uninstallation, or discontinuation of the Game.

Refunds

Refunds for in-app purchases are handled under the refund policies of the platform through which the purchase was made:

• Google Play: requests are submitted to Google under the Google Play refund policy;
• Apple App Store: requests are submitted to Apple under the App Store terms.

Nothing in this section limits any statutory right of withdrawal or refund that you may have as a consumer under mandatory law in your country of residence. If you believe you are entitled to a refund that the platform declines to process, contact us at the address in section 20 and we will review the request.

6. Advertising

The Game is distributed free of charge and is funded by advertising. By playing the Game you acknowledge that it displays advertisements supplied by third-party advertising networks, including banner, interstitial, and rewarded video formats.

We do not control the content of third-party advertisements and are not responsible for products, services, or websites advertised. Any dealings between you and an advertiser, including payments and delivery of goods, are solely between you and that advertiser. Information collected in connection with advertising is described in our Privacy Policy. You can limit ad personalisation through your device settings.

7. Privacy and Security

Our collection and use of information in connection with the Game is described in the Privacy Policy, which forms part of these Terms. Please read it carefully. We use reasonable technical and organisational measures to protect data transmitted by the Game, but no method of transmission or storage is completely secure and we cannot guarantee absolute security.

8. Standards and Conduct

You agree not to use the Game to:

• violate any applicable law or regulation;
• infringe the intellectual property or privacy rights of any person;
• transmit malware, or attempt to gain unauthorised access to the Game, our systems, or another user's device;
• interfere with or disrupt the Game, its servers, or the advertising or purchase mechanisms within it;
• use cheats, exploits, automation software, or unauthorised third-party software to gain an advantage;
• misrepresent your identity or affiliation with the Company.

9. Feedback and Submissions

If you send us feedback, ideas, suggestions, bug reports, or other materials ("Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, and incorporate them into the Game or any other product without compensation or attribution. You represent that your Submissions are your own and do not infringe the rights of any third party. We are under no obligation to keep Submissions confidential.

10. Intellectual Property Complaints

We respect the intellectual property rights of others. If you believe that material in the Game infringes your copyright or other intellectual property right, send a written notice to games@clawbuster.com containing:

1. your physical or electronic signature;
2. identification of the work you claim has been infringed;
3. identification of the material you claim is infringing and where it appears in the Game;
4. a way to contact you, such as an address, telephone number, or email address;
5. a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law;
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on the rights holder's behalf.

We may remove or disable access to material that is the subject of a valid notice and may terminate the access of repeat infringers.

11. Children and Minors

The Game is not directed to children under the age of 13 (or under 16 in certain EU jurisdictions), and we do not knowingly collect personal information from them. If we become aware that personal data from a child has been collected without verifiable parental consent, we will take immediate steps to delete it.

12. Third-Party Links and Services

The Game may contain links to third-party websites, stores, or services, including those reached through advertisements. Such links are provided for convenience only. We do not endorse and are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk and subject to their terms.

13. Devices and Game Progress

You are responsible for the device on which you install the Game, for the security of that device, and for any mobile data or connectivity charges incurred while playing. Game progress is stored locally on your device. Uninstalling the Game, clearing its data, resetting the device, or losing the device will erase your progress, and we are unable to restore it unless the Game expressly offers a cloud-save feature.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or device functionality, arising out of or in connection with your use of or inability to use the Game, whether based on warranty, contract, tort, or any other legal theory, and whether or not we were advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Game shall not exceed the greater of (a) the total amount you paid to us, if any, for in-app purchases in the twelve months preceding the event giving rise to the liability, or (b) EUR 50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Game, or your violation of any law or the rights of a third party.

17. Governing Law and Choice of Forum

Cypriot law governs these Terms and every dispute arising from them, its conflict-of-law rules set aside. The courts of Cyprus hold exclusive jurisdiction over such disputes.

If you are a consumer resident in the European Union, this choice of law and forum does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may also bring proceedings in the courts of that country.

18. Termination

These Terms remain in effect while you use the Game. You may terminate them at any time by uninstalling the Game and ceasing all use of it. We may suspend or terminate your access to the Game at any time, with or without cause and without notice, including where we reasonably believe you have breached these Terms.

Upon termination, the licence granted in section 3 ends immediately and you must cease all use of the Game. Provisions that by their nature should survive termination, including sections 9, 10, and 14 to 17, will survive.

19. Miscellaneous

Severability: if any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

Entire agreement: these Terms and the Privacy Policy together set out everything agreed between you and us about the Game, replacing any earlier understanding.

Modifications: we may revise these Terms. Playing the Game after a revision appears at this address counts as acceptance of it.

Assignment: you may not assign or transfer any rights or obligations under these Terms. We may assign ours. These Terms benefit our successors, assigns, and licensees.

Waiver: if we do not enforce a provision on one occasion, that provision still stands and remains open to us later.

Third-party rights: nobody outside this agreement gains rights under it unless we say so in writing.
